Saggy Pants Ban Faces Court Challenge

A Riviera Beach teen caught violating a saggy pants ordinance takes his case to court.

18 year old Julius Hart of Riviera Beach is charged with violating the city's saggy pants ordinance last September.   The ban makes it against the law to wear one's pants below the waist in public, exposing one's skin or underwear.   Hart's  attorneys are challenging the measure.

They argue it's unconstitutional.

Hart's attorneys called a fashion expert to the stand.

She testified lots of celebrities now wear their pants down below the waist exposing their underwear, and the saggy pants look has become mainstream and widely accepted. 

"I do think they're expressing quite a few things, but one of them is they're part of this group. They're part of a community that follows the hip-hop music scene, that possibly is rebellious to you know, their parents," said Carol Rousso, a fashion designer and instructor at the Art Institute of Ft. Lauderdale.

An attorney for Riviera Beach Police argues it may be disturbing to others to see someone's boxer shorts. He says police can legally enforce the measure because the city wants to improve its image.  Violators face a $150 fine.

The hearing will resume in two weeks on April 22.  Hart declined to comment as he left the courtroom.
