WEST PALM BEACH, FL (WFLX) - An elevator inside the Century Village in West Palm Beach comes crashing down killing the man trying to fix it.

But, Fox 29 has learned, the elevator shouldn't have been operating at all.

Something gave way and the Dover Building elevator came crashing down. The elevator worker, 39-year-old Jason Moyer, tried to escape, but couldn't get out in time. The owner of Xpert Elevator Service told us it was a quote an "unavoidable accident". He says Moyer took all of the safety precautions necessary, but a very old piece of equipment failed.

So, who's supposed to be monitoring the safety of our elevators? Private companies do the inspections. The state makes sure they are valid. This same elevator failed private inspection in February and the state told Century Village to fix it last year. We learned this isn't the only other Century Village elevator with problems. In the inspection reports, we also found many other elevators inside Century Village are not up to date on inspections.

So, you may be wondering why the state officials weren't out there more often to make sure the elevator was inspected properly. There are only 12 people that oversee inspections for all 49,000 elevators in the state. Century Village is not commenting. The state will be back out here to investigate Tuesday.

We're told the man who died has two young children.
