Tenant sues troubled high-end shopping center

PALM BEACH GARDENS, FL (WFLX)-The high-end-- but troubled-- Downtown at the Gardens shopping center faces a lawsuit by one of its tenants. Radiance Medspa, a health and beauty clinic, is suing Downtown in Palm Beach Gardens, alleging poor maintenance and neglect on the part of the management and owners.

The tenant's big gripe is a pair of dumpsters located behind the clinic. The lawsuit says the dumpsters have attracted insects and vermin, which has led to an infestation of fruit flies and roaches else where. Radiance claims the insects have resulted in a loss of business.

The suit also mentions the growing number of empty storefronts at Downtown. Radiance says that's further proof management doesn't care.

John McKeon, operations director at Radiance, declined comment on the lawsuit. However he stressed his company still does a good business, in spite of the economy and conditions at the shopping center.

Downtown is managed by national mall owner-developer Simon Property Group.  Late Monday the manager of Downtown, Brent Gardner, issued a statement. He says, "We are committed to maintaining the property to ensure a safe and enjoyable shopping environment. We continue to review options for a variety of retail and dining opportunities that will enhance Downtown at the Gardens."
