Challenge to Florida Class Size Amendment in court

TALLAHASSEE, Fla. (AP) - A lawsuit challenging the Legislature's proposed state constitutional amendment to loosen class size limits is getting its day in court.

A judge was going to hear the case Wednesday in Tallahassee.  The Florida Education Association, the statewide teachers union, contends Amendment 8's ballot summary is misleading because it fails to tell voters the proposal's main purpose is to cut public school funding.

The state says the union's claim is speculative and that no proof has been offered to support it.

The case possibly will wind up in the Florida Supreme Court.

The justices already have removed three other amendments, all proposed by the Legislature, from the Nov. 2 ballot due to inaccurate or misleading summaries.
