School bully captured on security camera

WEST PALM BEACH, FL (WFLX) - Bullying at school is a problem we hear a lot about, but not often is it caught on tape.

A West Palm Beach attorney has released cell phone video shot by a student of a bullying incident at Jeaga Middle School on October 27.

The video, captured in a 7th grade math class, shows 13-year-old Joshua Poole being bullied by a classmate. Although, he was the victim, the school suspended Poole for six days right along with the attacker.

The video of the incident was posted on YouTube, and the attorney for Poole's parents says they brought the video to the attention of school officials, who later apologized to the Poole family. "I send my kid to school to get educated, not to get killed. You know? It's really bad. It's really bad," said Clarence Poole, the victim's father.

Joshua says his attacker came over and started hitting him while he was seated. "He came over and started hitting me, and I was just trying to defend myself," Poole said. "But I was sitting in a chair, so I couldn't."

According to the boy's lawyer, the state attorney's office is considering a charge of battery against the alleged bully. He says there was a teacher in the classroom, but he was sitting at his computer and did not intervene or try to break up the fight.

The Palm Beach County School system made this statement: "The teacher in the classroom, Donald Charbonneau, pushed the call button requesting assistance from the office. When the students would not stop fighting, the teacher went to the hallway to get help. Assistant Principal Brent Higley responded and helped stopped the fight."

The attorney for Poole's parents says they intend to sue the school district for negligently supervising the class.
