Carmen Barahona claims also a victim


MIAMIA (WFLX) - Almost three weeks after her adoptive daughter was found dead, Carmen Barahona appeared before a judge.

"You are arrested on a warrant for first degree murder, which the charge holds no bond, seven counts of aggravated child abuse, no bond," said the judge to Barahona.

The 60-year-old is now facing the same fate as her husband, Jorge Barahona.

Meanwhile, her divorce attorney claims she is also a victim, and should not be held responsible for events that occurred inside her west Miami-Dade house.

In a newly released statement, Barahona's lawyer said:

"Given the tragic circumstances, it was inevitable that there would be additional criminal charges. Carmen Barahona will address the facts as part of the divorce case and in the criminal proceeding, once she obtains counsel, which will likely be public defender given her dire financial circumstances."

Both Carmen and Jorge Barahona are accused of the killing their adoptive daughter Nubia, whose body was found stuffed in a trash bag in the flatbed of Jorge's pest control truck.

Nubia's twin brother, Victor, who was also found in the truck, is recovering in a new home.

WTVJ in Miami reports his testimony suggests Nubia's fatal injuries were inflicted at their home.

Miami Dade County police is holding a news conference Monday to address details of Carmen Barahona's arrest.

WTVJ reports she has requested custody of her three surviving adopted children, including Victor.
