Parents of murdered 6 year old to sue

PALM BEACH COUNTY, FL (WFLX) - Makayla Sitton would have turned 8 years old this December. But on Thanksgiving night 2009, Makayla's young life came to a brutal end when she was shot three times in her own bed.

Nearly two years later, Jim and Muriel Sitton plan to sue the parents of the man, police say, killed their baby along with three other family members, including Muriel's mom.

According to a media advisory, the Sittons will file a lawsuit against Carole and Michael Merhige Thursday morning. The Sittons claim Carole and Michael knew their son, Paul, was dangerous.

According to statements made to police, Paul's parents said their son has lived with mental issues for years. Court documents also reveal his parents lived with fear over what their son might do.

In 2006, court documents show one of Paul's sisters, Carla, sought a restraining order against him after he threatened to kill her. "I'm going to slit your throat," he reportedly said.

The Sittons also claim Paul's parents knew he was headed to their Jupiter home Thanksgiving night, but chose not to tell them.

The Contact 5 Investigators discovered an email from Paul's mother, Carole, to an out of state family member. In the email, sent days before Thanksgiving, Paul's mother wrote of the family's plan to spend Thanksgiving with the Sittons. "Everyone is going up (including Paul!!). It will be interesting to say the least!"

By Thanksgiving morning, Paul's mom was quoted saying to one of her daughters, "I hope he doesn't come and kill us all tonight." Her daughter Lisa responded saying, "Mom it came to my mind but don't say that to dad because Dad would get upset that we had such ideas."

By 10:30 Thanksgiving night, police say Paul Merhige did just that, shooting and killing his twin sisters, Muriel Sitton's mom and her only daughter, Makayla.
