Judge in Goodman case won't step down

WEST PALM BEACH, FL (WFLX)  Judge Jeffrey Colbath has denied a request to recuse himself from the John Goodman case.

A jury convicted the Wellington polo mogul of DUI manslaughter in March.

Defense attorneys for John Goodman filed a motion asking Judge Colbath to step aside, alleging Colbath concealed evidence of jury misconduct.
 
Defense attorneys said Colbath did not tell them that Toni May, a former television host and executive director of South Florida Today on WXEL-TV, wrote him a letter in which she said she overheard a juror raise worries over possible jury misconduct at a Palm Beach Gardens restaurant the day after Goodman was convicted, before the judge agreed to interview jurors about the allegations.
 
In May's letter to Colbath, she alleges that jurors "believed [Goodman] was guilty before the trial ended," that a juror bullied two jurors who disagreed with him and that juror Dennis DeMartin was offered $50,000 for a book deal about the trial.
 
In a one page order the judge denied the motion as 'legally insufficient.'

On Monday, the day Goodman was expected to be sentenced, Colbath is expected to question jurors about allegations of wealth bias.
 
Goodman faces 30 years in prison.
