Colbath agrees juror acted improperly

WEST PALM BEACH, FL (WFLX) - New documents are shedding light on Judge Jeffrey Colbath's decision to deny John Goodman a new trial.

The order details how the judge agreed with defense attorneys who say Juror Dennis DeMartin did act improperly by conducting a drinking experiment the night before jury deliberations began in the case.

Goodman was sentenced to 16 years in prison for vehicular homicide for killing Scott Wilson in February of 2010.

The polo mogul is out on release pending an appeal of the conviction.
