Goodman attorneys want retrial moved out of PBC

WEST PALM BEACH, FL (WFLX) - Attorneys for International Polo Club Palm Beach founder John Goodman say they will file a motion to move his DUI manslaughter retrial out of Palm Beach County.

The attorneys announced their decision during a hearing with 15th Judicial Circuit Chief Judge Jeffrey Colbath on Wednesday morning.

"It might be a necessity at this point," Colbath said. "It might be the case where the [pre-trial publicity] threshold has been crossed."

Colbath said the case could be tried elsewhere in Florida or a jury could be brought in from a city such as Jacksonville to hear the case.

In May, Colbath ordered a new trial for Goodman after defense attorneys proved allegations of juror misconduct.

Attorneys argued that Dennis DeMartin, one of the jurors who convicted Goodman of DUI manslaughter in connection with the death of University of Central Florida student Scott Wilson, did not disclose an ex-wife's DUI arrest during jury selection.

In 2012, Goodman was sentenced to 16 years in prison and remains on house arrest.

DeMartin faces contempt of court charges.

Colbath said he would consider the change of venue motion during a hearing on October 8th.

Attorneys said the earliest they would be ready for a retrial is January.
