SUBURBAN LAKE WORTH, FL (WFLX) - Eulalia Gaspar is heartbroken and also angry. Her daughter, Priscilla, 3, was killed after being struck by a truck in suburban Lake Worth on Monday.

"I close my eyes and I just think of my Priscilla," said Gaspar, through a Spanish language translator. "I see her running and walking and telling me 'mama, I love you'," she said.

Priscilla was hit by a pick-up truck driven by Steven Barnes, 56, on Kirk Road just south of Lake Worth Road.

According to state driving records, Barnes had six drunk driving arrests between 1979 and 1999. The state considered Barnes such a threat, it permanently revoked his drivers license, according to documents.

"Why has he still not been arrested? Why is he free?," asked Gaspar. "I don't understand why they don't want to arrest him," she said. "Why can't he pay for what he did to my daughter?"

The Palm Beach County Sheriff's Office is investigating Barnes' claim that a 'medical emergency' caused him to lose control of the truck.

Because Barnes is being cooperative and because he is not considered a flight risk, investigators will wait for the Palm Beach County State Attorney's Office to determine if any charges - or an arrest - are on the way.

"Once we start filing charges all the time clocks start ticking and of course if we make an arrest now we have a certain amount of time to bring a case to trial," said prosecutor Brian Hernandez.

"I don't have my daughter," responded Gaspar. "I don't have her love... and this man is still free."

Prosecutors say if Barnes were only to be charged with driving with a revoked license, the penalty would be a minimum of no jail time to a maximum of five years.

As of late Tuesday, no charges had been filed.

The investigation continues.
