Dennis DeMartin to remain in jail

WEST PALM BEACH, FL (WFLX) - Dennis DeMartin, the juror convicted of jury misconduct in John Goodman's DUI manslaughter trial, will remain behind bars for now.

A judge denied one of two appellate bonds during an emergency hearing Friday morning.

The hearing only lasted about 30 minutes at the Palm Beach County Courthouse, and it didn't take Judge Jeffrey colbath long to decide that he would not set DeMartin's bail on one of the counts.

DeMartin has served about 30 days of his 6 month sentence.

Judge Colbath did reduce DeMartin's bond on count one to 25-hundred dollars, but let stand his ruling of no bond on count two.

The judge said he will only set DeMartin's bond on the second count if the 4th District Court of Appeals comes back and overrules his decision.

Attorneys for DeMartin say they plan to take the ruling back to the appeals court, but they have several factors working against them. They say DeMartin may have served the whole sentence by time the appeals court rules and, if the bond is reduced, attorneys say he doesn't have the money to post bond and they are looking for him to be released on his own recognizance.

A panel of six jurors, including DeMartin, convicted Goodman of DUI manslaughter in connection with the death of University of Central Florida student Scott Wilson in 2012.

Colbath later vacated Goodman's conviction after DeMartin admitted that he conducted a drinking experiment before jury deliberations.

DeMartin was also accused of hiding a former wife's DUI arrest from attorneys and Colbath.
