BOCA RATON, FL (WFLX) - A man is in critical condition at Delray Medical Center after a deputy-involved shooting in suburban Boca Raton.

Update, MON 12 PM: The Palm Beach County Sheriff's Office says it's planning to release Monday the name of  the off-duty deputy who shot a man by a pool early Saturday morning.

According to the sheriff's report, the deputy caught a couple having sex in the pool area in the community "Reflections of Boca Del Mar" in Boca Raton.

An altercation followed, and the deputy fired his weapon at Anthony Ribeiro after he allegedly threatened the officer.

Ribeiro remains in critical condition at Delray Medical Center. The deputy has been placed on administrative leave while detectives investigate.

Previously: A man is in critical condition at Delray Medical Center after a deputy-involved shooting in suburban Boca Raton.

An off-duty deputy, who lives in Reflections of Boca Del Mar, entered the pool area of the complex and says he encountered a male and female engaged in sexual activity.

The off-duty deputy advised the couple that he is a deputy and asked the couple, who does not live in the area, to leave the premises.

They did so reluctantly, according to the Palm Beach County Sheriff's Office.

A short time later the couple returned.

PBSO said the male suspect, later identified as Tony Ribeiro, 49, approached the off-duty deputy, who was sitting in a lounge chair, and hovered over him in a threatening manner.

An altercation ensued and Ribeiro raised a glass wine or champagne bottle and attempted to strike the off duty deputy, officials say.

The deputy fired his weapon, striking Ribeiro.

Dane Jones, who is from Ohio and visiting family, heard the gunshots. "Came over here to the pool and I heard about four five gunshots and I've seen a bunch of swat team and ambulance"

Detectives are investigating the incident and the off-duty deputy has been placed on administrative leave, which is standard department protocol.

PBSO has not released the name of the deputy.
