Aldo Alvarez declared competent to stand trial

WEST PALM BEACH, FL (WFLX) - A judge decided Friday morning Aldo Alvarez, the mentally challenged man shot by a Palm Beach County sheriff's deputy, has regained competency.

According to the suspect's attorney, Wayne Richter, a doctor told the court Friday morning Alvarez was now fit to stand trial.

Alvarez was not in court Friday and remains in the South Florida Evaluation and Treatment Center. However, he will be sent back to the Palm Beach County Jail, according to his attorney.

Alvarez was shot by Deputy Joshua McGehee in the deputy's driveway in Royal Palm Beach May 8, 2013.

According to investigators, McGehee was defending himself and was attacked by Alvarez. They say the deputy was off duty and just returned home from the gym when they say Alvarez came at the deputy in an aggressive way.

Alvarez's parents said their son is mentally challenged and would never hurt anyone.
