PBC judge declares Florida's ban on same-sex marriage unconstitutional

PALM BEACH COUNTY, FL (WFLX) - A Palm Beach County Circuit judge issued a ruling saying Florida's ban on same-sex marriage is unconstitutional.

Judge Diana Lewis's opinion came down in the probate case of W. Jason Simpson and his recently deceased partner of 37 years, Frank Bangor, 61.

According to Simpson's Attorney, Andrew Fein, Simpson and Bangor were legally married in Delaware in 2013, but when Bangor passed in 2014, Simpson had no legal rights to their joint property here in Florida as same-sex marriage is not recognized. 

Palm Beach County is the third South Florida county to issue such a ruling on same-sex marriage.
