Guardrail maker slapped with $175 million verdict for not disclosing design changes


MARSHALL, TX (WFLX) - A jury in Texas awarded a $175 million verdict against a guardrail maker and found the company, Trinity Industries, failed to disclose changes to the design of the guardrail head.

The company was the subject of a Contact 5 Investigation from November 2013. People injured in guardrail crashes said it pierced into the vehicle like a spear.

Crash tests show the guardrail is supposed to peel away from a car when hit head on. The Contact 5 Investigation uncovered the company failed to tell the Federal Highway Administration and the Florida Department of Transportation that a one inch change had been made to the guardrail's feeder chute.

The jury heard that the changes were a cost-savings measure.

The company is expected to appeal.
