Link between Arias prosecutor and holdout juror

Jodi Arias Jodi Arias
PHOENIX (CBS5) -

A very intriguing development unfolded after the name of the holdout juror in the Jodi Arias sentencing retrial was released.

CBS 5 News uncovered court documents that show that juror, whose holdout vote for a life sentence forced a mistrial and saved Arias from the death penalty, has a link to Maricopa County prosecutor Juan Martinez., the Juan Martinez that prosecuted Arias.

It turns out that juror No. 17, the holdout juror, was formerly married to a man who was prosecuted by Martinez in the late 1990s.

The juror's former husband was arrested for first-degree murder and burglary. Court records show Martinez was the assigned prosecutor on both cases.

The murder charge was dismissed for unknown reasons. Then in May 2000, the ex-husband was sentenced to four months in jail for the burglary. Records show during the time those cases were making their way through court, juror No. 17 and the man being prosecuted by Martinez had their first of two kids together and got legally married.

This is a twist that no one saw coming. And it raises a lot of questions.

We don't know if the juror disclosed this information during jury selection or if she even realized Martinez was the same prosecutor as the one in her former husband's case. It's also unclear if Martinez did his due diligence or if it's something he missed during jury selection.

It's also unclear what impact, if any, this revelation could have on the Arias case.

The Maricopa County Attorney's Office would only say they are aware of the issue and are looking into it.
