BOYNTON BEACH, Fla. - The victim accusing a Boynton Beach police officer of rape spent the day testifying about what she described as a violent attack.

As she provided graphic details, the former officer Stephen Maiorino and his wife and family listened.

"He took out his gun and he pulls out the magazine and the clip and he looks me in the eyes and he tells me if you tell anybody I will find you and I will kill you," the alleged victim told the jury.

At times crying, the victim said she screamed from a field near Interstate 95, but it was loud and no one could hear her.

"He walked from the trunk back to the front of the car...pointed the gun at me and told me to take off my clothes," the alleged victim said.

But the officer's defense attorney Michael Salnick told the jury that the sex was consensual.

He pointed out that the alleged victim was drinking alcohol before the encounter in October, despite the fact she was underage.

And he told the jury about an ongoing lawsuit between the alleged victim and the Boynton Beach Police Department.

"While you may not like the fact that while on duty Officer Maiorino gave into this moment which we would all agree wasn't the smartest thing...the evidence will show that no crime occurred," Salnick said.

Salnick also brought up a picture tracked down from years ago he says shows the alleged victim posing face down on the hood of a patrol car.

The victim said it was a joke with friends and admitted she never brought it up during her interviews with detectives.

"The evidence will show what a distinctive and shockingly similar description that is to what she describes here," Salnick said.

Prosecutors say the officer's DNA was found on the victim's neck and breast.

Her DNA was found on the hood of the police car and in the suspect's underwear.

If convicted, the former officer faces life in prison.
