Motion hearing today for Dalia Dippolito retrial

The retrial for a Boynton Beach woman accused of a murder-for-hire plot against her husband in 2009 is set to begin next week.

Jury selection will begin Thursday.

Dalia Dippolito, 34, will stand trial for the 2009 charge of solicitation to commit murder. Her defense attorneys will be in court Wednesday afternoon for a motion hearing to exclude certain evidence and testimony during the trial.


One of the seven motions filed is asking the court to exclude video of a staged crime scene set up by Boynton Beach police and featured on the television show "COPS" to get Dippolito’s reaction when officers made her believe her husband, Michael Dippolito, was dead.

Another motion asks the court to exclude video of Dippolito at the Boynton Beach Police Department, stating BBPD staged a theatrical crime scene for "COPS" and that a jury will not be able to “overcome” what they see in the video to “properly determine” whether Dippolito committed the act of solicitation.

In a February pre-trial hearing earlier this year, Dippolito took the stand and said she didn’t actually want to have her husband killed.

She claimed at the hearing the entire murder-for-hire plot was planned with her husband so they could get a reality show and get famous. She said she was just acting in hidden police videos.

Dippolito was sentenced to 20 years in prison in 2011 after a jury convicted her, but an appellate court later overturned the verdict.
