According to the probable cause affidavit, the sexual assault case against PBSO deputy Jason Nebergall stems from a disturbance call that Nebergall responded to in July. The incidents involved fights between the female victim and her landlord. The latest incident took place around 5 a.m. on July 21.

The probable cause report states that a deputy, identified as Nebergall, told the woman, “You look pretty. You don’t look like you been beat up twice.” The report says he then requested to speak to her away from the other responding deputies, at which time he offered to come back to check on her at her home. The report states that the victim agreed.

About 30 minutes later, the report says Nebergall knocked on the victim’s door. He was dressed in his uniform. The report states that when the woman walked outside, Nebergall grabbed her by the hair, kissed her and made a comment about her breasts.

The report states that Nebergall pressed himself against the woman and told her to touch and kiss his genitalia, while unzipping his pants. The woman told PBSO investigators that Nebergall tried to penetrate her, but stopped because he couldn't "do this without a condom."

The report says he kissed her again and said he would check on her later. The report stated that Nebergall didn't threaten her but the woman added, "She was scared of him because of what he could do to her." The woman told investigators, "Although I didn't say no verbally my body language said different."

After the incident, the victim went to a PBSO substation to file a complaint and submit evidence for a sexual battery examination.

On July 22, Nebergall was approached by PBSO investigators and was informed that he was being investigated for sexual battery. According to the report, the deputy told investigators that he did come back to the residence to check on the woman but when asked if he touched her, he replied "no".

The report says Nebergall was then served with DNA search warrant. The DNA results, released in October, stated that Nebergall's DNA matched the DNA found from the female victim's sexual battery examination.

Nebergall appeared in court this morning and is being held on two counts of sexual batter. His bond is $100,000.
