Judge rules city must clean up beach

A judge ruled in favor of Fane Lozman, who sued the city over beach access near his Singer Island property.

Lozman argued Riviera Beach was responsible for that section of the beach and had failed to keep it up to the point that it was impassable.

Riviera Beach decided not to repair the access and easement and went to court over the issue instead.  The city had argued that restoring and rebuilding were not specifically outlined in the previous court order. The city also cited the cost to do so.

Lozman said without public easement the beach would then be private.

A judge ruled on the issue in favor of Lozman, directing Riviera Beach to rebuild any structures located on the easement.

This case is just one of several filed against RIviera Beach by Lozman. Most notably, he sued the city after it seized and destroyed his floating home.

That case went all the way to the U.S. Supreme Court, who ultimately ruled in his favor.
