Father in child neglect case has new claim

A man facing child neglect charges in Palm Beach County argues the laws don’t apply to him.

In a court hearing Monday morning, Donell Barron is expected to argue that the 15th Circuit Court of Florida has no jurisdiction over him.

In correspondences filed with the clerk of court, Barron points out he is a member of the Yamassee Indian Nation and follows the Yenyi Constitution.


A judge is scheduled to decide Monday morning whether Barron can represent himself in the criminal case. But Barron asked the hearing to be pushed back until issues about jurisdiction can be resolved. As of Monday morning, the hearing was still scheduled to take place.

Deputies arrested Barron and his wife, Rikki Hart, in December.

The Palm Beach County Sheriff’s office said the couple and their five children were living in a car parked outside a Greenacres Walmart. The children, ages 4 to 14, were malnourished and underweight, according to deputies.

Hart is also scheduled to be in court Monday for an arraignment on amended child neglect charges. It does not appear she is using the same defense strategy as her husband.
