COPY-Palm Beach County refuse to overturn

WEST PALM BEACH, Fla. (AP) - A panel of Palm Beach County judges has ruled that a software glitch in a system used to test alcohol levels has been fixed and can't be used by DUI defendants to challenge evidence.

The Intoxilyzer 8,000 system is used by every Florida county.

A group of defense attorneys in Palm Beach County had argued that all test results from the time the county began using the system in March of 2006 should be invalidated because of the software glitch.

The Palm Beach County case was based on a glitch discovered last year that resulted in 224 DUI cases being thrown out statewide. The Intoxilyzer registered valid samples that should have been rejected because the suspects did not blow enough air into the machine.

Richard Springer -- the lead defense attorney in the case -- said today's ruling would not end controversy surrounding the Intoxilyzer 8000.
