PUNTA GORDA, Fla. (AP) - A Charlotte County jury has found a man guilty of second-degree murder for the death of his infant son.
The six-member jury deliberated for 90 minutes before convicting 21-year-old Charles Eubanks yesterday. Twentieth Circuit Judge J. Frank Porter scheduled sentencing for October 31st, when Eubanks faces life in prison.
Eubanks was home alone with his 4-month-old son Matthew the day the baby died in June 2004. Eubanks told detectives that he "shoulder-butted" the recliner Matthew was sitting in, causing the baby to fly out of the chair and hit his head on a table.
Prosecutors say that is not what happened.
Assistant State Attorney John Burns says it was clear the child was beaten to death.
Doctors testified that Matthew died from multiple skull fractures and severe brain injury.
A telephone message and e-mail left for his attorney was not immediately retuned.
