WELLINGTON, FL-The Palm Beach County Sheriff's Office says 22-year old Robert Tomlin is the masked intruder who was shot and killed by a Wellington resident early Monday morning.

It happened on Birkdale Drive, off Wellington Trace. The Sheriff's Office says a couple renting a duplex there, were awakened by their Jack Russell Terrier barking. Deputies say Tomlin, the intruder, and 34-year old resident Heath Miller, argued, then exchanged gunfire. Tomlin died at the scene.

Tomlin lived with a cousin, around the corner from the Miller's, no more than a half block away. The cousin tells us Tomlin was "never a problem child" and that he watched her children. According to jail records, Tomlin had a history of arrests, including battery on a pregnant woman in 2007, and battery and resisting arrest in 2006.

Miller, the victim of the home invasion, is a band director at Howell Watkins Middle School in Palm Beach Gardens, and from a prominent Belle Glade family. Miller's father, Henry, is a funeral director in Belle Glade, and his mother, Harma, was a city commissioner there. When we contacted Henry Miller, he told us his son was resting.

At the duplex where the home invasion and shooting took place, a work crew had installed plywood over a sliding glass door at the rear of the unit. A "for rent" sign hung near the front door. The landlord says the Miller's planned to move soon.

Neighbors called the home invasion disturbing. "We moved here to get away from this," said David DeMaio. "To have someone come in armed like that, it's very very very scary."

Added Kenny Berry, "I don't know exactly what happened, but if you've got to defend your home, that's what you'll do if someone comes in uninvited."
